The general conditions govern the security and contractual relationship of the transactions between the User and Eathos. By using this site, you confirm that you have read and accepted the general terms and conditions per user. The aforementioned is applied, regardless of the position from which the site is used. If you use some extra services on this site, we will notify you of the additional conditions, and these will be part of the general conditions.
These general conditions can be changed at any time without notice. Any purchase after the amendment implies acceptance of the new conditions by the User. The general conditions could be completed by other conditions, if explicitly indicated. In the event of contradiction, these general conditions will have priority.
The definitions of the terms used in these Terms and Conditions are defined, to the extent necessary, in the article "Definitions" of the general conditions.

ACCURACY OF THE CONTENT
The information regarding products and prices, or detailed information on the order that the User can find, is prepared and communicated subject to changes and corrections. Modifications to the contents may be made regularly without informing the User explicitly. Eathos has made every reasonable effort to ensure that the information is accurate and to accurately display the colors of our products. Product weights, sizes and volumes are accurate but with margins of tolerance, however we cannot guarantee that your screen will accurately reproduce the color of the product that will be delivered.
Eathos cannot be held responsible for the use of this site, including and without limitations, its contents and possible errors. The information shown is presented in detail and to the best of our ability and we cannot be held responsible for any incorrect data displayed.

PRICES
All prices published on the site include VAT. Shipping costs are not included except where indicated. The currency is always clearly shown. When an error is detected regarding the indication of the price of the products ordered, the user will be informed as soon as possible and will be offered the option to cancel the order, free of charge.

ONLINE ORDER PROCESS
If you are of age 18 or older, you can place an order. The ordering process consists of the following phases:

When you place an order to buy a product, we will send you an e-mail of receipt of your order which will contain all the details. If you pay by credit card, you will receive an e-mail containing the payment status.When the products are shipped, we send you a confirmation e-mail in which we inform you that we will send you the product ordered (the "Shipping Notification E-mail"). All orders are subject to product availability. On the occasion of unexpected lack of stock of one or more items in the order, we will inform you and you will have the right to cancel a booking order.

PROTECTION OF PERSONAL DATA
Eathos uses all reasonable efforts to protect User data. A credit card payment will be kept online only through the services offered by an online Payment Service Provider, Stripe. Stripe, a PCI approved payment gateway https://stripe.com/at. Standard "Secure Sockets Layer" (SSL) internet encryption technology provided by Wix will be used to transfer other personal data to the Eathos database.
The servers will be hosted on the Wix platform and an internet hosting provider. These servers contain personal information, but will not contain all information regarding payment methods or bank documents. The servers are protected by a multilevel firewall and a standard security protocol.

PAYMENT
The payment methods we accept are indicated on our website. The account will be debited in the currency that was selected. With respect to our methods of payment for credit cards, also with regard to security methods, please see the privacy policy published on the site.
Eathos will remain the owner of the goods sold until the day of full payment of the price and any late payment of interest and / or compensation.

SALES CONTRACT
A "sale" is intended for the online purchase of an item that will be sent to your address. Payment is made in advance. At that moment the purchase takes place. The order will be shipped only after receipt of payment.
Eathos reserves the right to refuse an order in the following cases:

If there is a serious suspicion of abuse of right or lack of good faith by the User;

If the end of the stock is reached or if a product is no longer available;

If an invalid offer is determined;

In case of force majeure.
DELIVERY RESTRICTIONS

We do not accept post office addresses and APO military addresses

Delivery on Saturdays is only possible after checking the availability of the service by the courier in charge. The normal delivery service is operated from Monday to Friday, except public holidays.
DELIVERY
When we ship the ordered goods from our warehouse, we will send you an e-mail to inform you. This e-mail will contain the shipping information of your package, the package number and a link to track the package on the courier's website. The courier's contact information is indicated on the same site of the shipper.
Our products are only delivered in those countries for which the website allows delivery. We will use reasonable efforts to deliver the ordered products within the terms indicated in the order confirmation. Possible delays will lead, in no case, to the payment of compensation. Addresses incorrectly communicated are the responsibility of the User and may lead to additional costs that will be paid by the User.
All goods will be sent by Eathos. If the product is not delivered within the specified time, please contact help@eat-hos.eu with the customer number or order number. If exceptional circumstances confirm the fact that you have not received any item you have ordered after 30 days from the date of dispatch notification email, you will have the option to cancel the order and request a full refund.
We only ship via a professional courier. Please note that we always need someone to sign on delivery. It can be accepted that a delivery is signed by a person other than the customer, provided that this person is present at the address indicated. If nobody is present at the time of delivery, the courier will ask you to make an appointment for a second attempt to deliver the goods. This can be done by telephone or a card left in the letterbox.

DEFECTIVE PRODUCT OR WRONG DELIVERY
You must check whether the products are correct at the time of delivery. In the event of a discrepancy or problem with your order, you must note the nature of the discrepancy or problem on the delivery note or do not sign for the package. You must send us a written notification of the problem by email to help@eat-hos.eu within 24 hours of the delivery date. For defective products, however, following a manufacturing error by the manufacturer, or if Eathos has delivered the wrong goods, Eathos will bear all shipping costs for returning the goods.

LIMITS OF LIABILITY
a. Use of the site: Eathos is not responsible for events deriving from the uninterrupted availability or access of the Site, disturbances arising from the computer's operating system, viruses or other inconveniences that may arise from the use of the site itself (including, without limiting, any data loss)
b. Legal guarantee
There is a 2-year guarantee for the consumer. This warranty only covers a lack of conformity already existing in the goods supplied. During the above period, the seller undertakes to replace or repair the goods in question (or parts) free of charge. The seller reserves the right to replace the item if the repair costs are disproportionate, or if the repair is impossible. The defects that appear after a period of 6 months from the delivery date are not considered to have been present at the time of delivery, unless the customer proves it.
c. Warranty conditions
To appeal the guarantee, the customer must present the relative receipt or invoice. The guarantee is not transferable. Any defects must be reported within two months of their discovery. After this period, any right to repair or replace is void.
d. Exclusions
The warranty does not apply to defects resulting from accidents, deterioration of the conditions due to negligence, falls, use of products in conflict with the purpose for which they were made, failure to follow the instructions for use or the manual, adjustments or modifications to the unit, approximate use, incorrect installation, poor maintenance, improper commercial or abnormal use
Use of the products: Eathos is not responsible for the loss, for the material or other damages of any nature, that the User or third parties could suffer in the use of the products.
e. Delivery and other exclusions
Eathos cannot be held responsible for the violation of any term, since all deadlines are purely indicative without any obligation on the part of Eathos, nor for any damage that may have been caused by its fault or negligence, including cases of gross negligence. Any significant damage or any other damage not foreseeable by one of the parties at the time of conclusion of the sale will not entail any compensation.
The entire responsibility of Eathos will never exceed the value of the product in question purchased.

REFERENCE TO OTHER WEBSITES AND USE OF THE MATERIAL THROUGH THE SITE
Reference to another website via our site is for informational purposes only. The information on the site can only be used with the explicit consent of Eathos. It is prohibited to modify, reproduce, download, distribute, transfer, or exploit and / or share on the market, the services, the pages of the site, or the calculation codes that refer to the site.
The information and suggestions sent to us via the site can be used without obligation and without compensation by Eathos.

Annulment

APPLICABLE LAW
Any dispute regarding the closure, validity, interpretation or execution of the contract or of the general conditions is exclusively governed by Italian law and the competent Court is the Court of Ferrara (Italy). All parties agree to accept electronic evidence (eg e-mail, back-up, ...) as evidence in the event of disputes.
If any of these terms and conditions could be declared invalid or not applicable, the other general conditions will remain valid and the deadline declared will remain applicable within the limits set by the law.
Conclusion
These general conditions constitute the entire agreement and replace all previous agreements with the User.
